By accessing and using the MCP Tournament Manager platform ("Service"), you accept and agree to be bound by these Terms of Service.

If you do not agree to these terms, you should not use our Service.

2. Service Description

MCP Tournament Manager provides:

• Tournament creation and management tools
• Participant registration and tracking
• Bracket generation and match scheduling
• Results tracking and leaderboards
• Tournament sharing and embedding capabilities

3. User Accounts

To use certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us of any unauthorized access

4. Tournament Management

As a tournament organizer, you agree to:

• Provide accurate tournament information
• Manage tournaments fairly and transparently
• Comply with all applicable laws and regulations
• Not use the platform for illegal or fraudulent activities

5. Content Guidelines

Users must not post content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malicious code or spam
• Is defamatory, offensive, or inappropriate
• Misrepresents tournament results or standings

6. Subscription and Billing

Our Service offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to:

• Pay all applicable fees according to the selected billing period (monthly or yearly)
• Automatic renewal of subscriptions unless cancelled before the renewal date
• Provide accurate and complete billing information
• Update payment information when necessary

6.1 Pricing and Payment

• Free tier: $0/month with limited features (1 concurrent tournament)
• Pro tier: $9/month or $95/year with full features (10 concurrent tournaments)
• Prices are in USD and subject to change with 30 days notice
• All payments are processed securely through PayPal
• Applicable taxes may be added based on your location

6.2 Billing Cycle

• Monthly subscriptions renew on the same day each month
• Yearly subscriptions renew on the anniversary date
• Billing occurs at the beginning of each period
• No partial month/year refunds for cancelled subscriptions

6.3 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You retain access to Pro features until the period ends
• No refunds for unused time in the current billing period
• Downgrading from Pro to Free is immediate with no refund

6.4 Failed Payments

• Failed payment attempts may result in service suspension
• We will attempt to notify you of payment failures
• Access may be restored upon successful payment
• Repeated failures may result in account termination

7. Service Availability and Limitations

7.1 Free Tier Limitations

• Maximum of 1 concurrent tournament
• Basic features only
• Community support
• Subject to availability and capacity limits

7.2 Pro Tier Benefits

• Up to 10 concurrent tournaments
• Advanced AI features
• Priority support
• Custom workflows
• Analytics dashboard
• Early access to new features

7.3 Fair Use Policy

• Service usage must be reasonable and not abuse system resources
• Automated or bot usage is prohibited without prior approval
• We reserve the right to impose limits on excessive usage
• Violations may result in service throttling or termination

8. Data and Privacy

Your use of our Service is also governed by our Privacy Policy. By using the Service, you consent to:

• Collection and processing of tournament data
• Storage of participant information
• Sharing of public tournament information
• Analytics for service improvement

9. Intellectual Property

The Service and its original content, features, and functionality are owned by MCP Tournament Manager and are protected by international copyright, trademark, and other intellectual property laws.

Tournament data created by users remains their property, with a license granted to us for platform operation.

10. API and Integration

If you use our API or embedding features:

• You must comply with our API usage guidelines
• Rate limits and quotas must be respected
• Commercial use requires prior approval
• Attribution must be maintained where required

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for:

• Service interruptions or data loss
• Errors in tournament results or calculations
• Actions of tournament organizers or participants
• Third-party integrations or services
• Loss of revenue or profits
• Any indirect, incidental, or consequential damages

Our total liability shall not exceed the amount paid by you for the Service in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless Polis, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post or tournaments you organize

13. Termination

We reserve the right to:

• Terminate or suspend accounts for violations
• Remove content that violates these terms
• Modify or discontinue the Service
• Change these terms with notice

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

• Good faith negotiations between parties
• Binding arbitration if negotiations fail
• Small claims court for qualifying disputes
• Class action waiver: You agree to resolve disputes individually

15. Governing Law

These Terms are governed by applicable laws. Any disputes shall be resolved through appropriate legal channels.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon:

• Posting updated Terms on our website
• Providing 30 days notice for material changes
• Immediate effect for changes required by law
• Your continued use constitutes acceptance of modified Terms
